Definitions
1.1 ‘Product or ‘Products’ include handmade items or any other type of goods or services offered through this website.
1.2 ‘Vendor’, ‘me’, ‘we’ or ‘us’ means https://giftofembroidery.com website, owned and operated by Yulia Panchenko.
General
2.1 These Terms and Conditions and Privacy Policy apply to any purchase of products or services from the Vendor.
2.2 These Terms and Conditions and Privacy Policy may be amended periodically and you will be deemed to have accepted any amendments if you use the website after those amendments have been posted.
Contract and prices
3.1 All prices are in Canadian Dollars and include HST, unless otherwise indicated.
3.2 Description of products and prices may be subject to change or correction at any time without notice. Although we seek to ensure information is correct, we make no representation or warranty as to information being accurate or complete. If we discover an error, we will try to notify you as soon as possible and allow you to cancel your order and obtain a refund if desired.
3.3 By submitting an order you warrant that:
– you are capable of entering into a legally binding contract with the Vendor,
– you are authorized and able to make payment via the method you have chosen,
– the information you have provided is correct,
– your purchase is not made for the purpose of commercial resale.
3.4 A contract for purchase is only formed once we have accepted a payment via Paypal, Credit Card or Visa Debit.
3.5 Payment method:
Payment can be made with credit/debit cards through Paypal and Square (secure payment).
Turnaround, Shipping and Delivery
4.1 Turnaround time or processing time for most of the items is 2-5 business days, unless stated otherwise in the product listing. We do our best to process and ship orders as soon as possible.
4.2 Shipping is only available for Canada and USA. Most of the orders are shipped with Tracking Shipping service (by Canada Post, USPS, UPS, Fedex, Purolator or Canpar).
4.3 Local pickup is available from the company location in East Gwillimbury, as per prior agreement with the Vendor.
4.4 Please double check the shipping address during checkout. The shipping address is copied onto the package as is, and we are not responsible for any spelling mistakes that may cause non-delivery.
4.5 Please contact us BEFORE ordering if you need an item for a specific date.
4.6 Duty, customs, and brokerage fees are the responsibility of the Buyer. We are not responsible for delays due to customs.
4.7 Estimated shipping times:
- Shipping to USA: 2-7 business days delivery by USPS or UPS
- Shipping within Canada: 1-7 business days delivery by Canada Post or other carriers (depending on destination)
4.8 Please note that shipping delays might occur, which is beyond our control. From our part, we can guarantee that your order will be processed and shipped within the indicated time frame which you will see at the checkout.
Returns & exchanges
5.1 Refund is only allowed on items that have been received damaged in transit. Please contact us THE SAME DATE the item received so that we may resolve the problem and attach the photo of the damaged product. Please be sure to check your package upon delivery, as we cannot accept claims after 2 days of receipt.
5.2 We will accept a custom/personalized item back only if we made a mistake (spelling, embroidered character). In this case please contact me within 3 days of delivery. We will re-do and re-send the correct item to you.
5.3 We don’t accept any cancellations. But please contact us if you have any problems with your order.
Warranties and Liabilities
6.1 The Vendor excludes any condition or warranty, unless it is expressly set out in these Terms and Conditions or is by law incapable of exclusion, restriction or modification.
6.2 The Vendor will under no circumstances be liable for any indirect, incidental or consequential loss or damage arising in relation to any transaction entered into, or any products or services purchased, through this website.
Copyright
7.1 The photos of the items in this shop are made by the Vendor and are subject to copyright. Any unauthorized use of these photos will be considered copyright infringement and will be prosecuted.
7.2 By purchasing a custom made item you agree that the Vendor can use photos of your ordered item for marketing purposes. The photos of all the Gift of Embroidery items listed here may appear in social media and/or published by the shop owner. Please let us know if you DON’T want the photo of your order to be published or used in any other way, and we will keep them private.
Privacy
8.1 The Vendor respects your privacy, as well as the confidentiality and the security of personal information provided by you. All information supplied by you is used by GiftOfEmbroidery.com solely for communication or promotion purposes.
8.2 The Vendor uses the information provided by you through the order process only to ship the product and to confirm delivery. We do not share this information with any third party.
8.3 When signing up for a newsletter from GiftOfEmbroidery.com, your email address is kept confidential and is used only for the purpose of sending newsletters, updates or special promotions.
Data Security
9.1 All the orders placed through this site are processed via PayPal and Square. These payment methods use the technology to keep your information safe. When you send a payment using PayPal or Square, we do not receive any sensitive financial information like your credit card or bank account number from PayPal. We only receive your shipping address and email, and use it to communicate with you about your order and to ship the purchased product.
Law
10.1 These Terms and Conditions are governed by the laws of the Province of Ontario, Canada. The parties irrevocably submit to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.
