‘Vendor’, ‘me’, ‘we’ or ‘us’ means https://giftofembroidery.com website, owned and operated by Yulia Panchenko.

GENERAL

These Terms and Conditions and Privacy Policy apply to any purchase of products or services from the Vendor.

These Terms and Conditions and Privacy Policy may be amended periodically and you will be deemed to have accepted any amendments if you use the website after those amendments have been posted.

CONTRACT AND PRICES

  • Description of products and prices may be subject to change or correction at any time without notice. Although we seek to ensure information is correct, we make no representation or warranty as to information being accurate or complete. If we discover an error, we will try to notify you as soon as possible and allow you to cancel your order and obtain a refund if desired.

  • By submitting an order you warrant that:

       – you are capable of entering into a legally binding contract with the Vendor,

       – you are authorized and able to make payment via the method you have chosen,

       – the information you have provided is correct,

       – your purchase is not made for the purpose of commercial resale.

  • A contract for purchase is only formed once we have accepted a payment via Credit Card or Visa Debit.

  • Payment method:

Payment can be made with credit/debit cards, Apple Pay & Google Pay.

WARRANTIES & LIABILITIES

  • The Vendor excludes any condition or warranty, unless it is expressly set out in these Terms and Conditions or is by law incapable of exclusion, restriction or modification.

  • The Vendor will under no circumstances be liable for any indirect, incidental or consequential loss or damage arising in relation to any transaction entered into, or any products or services purchased, through this website.

COPYRIGHT

  • The photos of the items in this shop are made by the Vendor and are subject to copyright. Any unauthorized use of these photos will be considered copyright infringement and will be prosecuted.

  • By purchasing a custom made item you agree that the Vendor can use photos of your ordered item for marketing purposes. The photos of all the Gift of Embroidery items listed here may appear in social media and/or published by the shop owner. Please let us know if you DON’T want the photo of your order to be published or used in any other way, and we will keep them private.

PRIVACY

  • The Vendor respects your privacy, as well as the confidentiality and the security of personal information provided by you. All information supplied by you is used by GiftOfEmbroidery.com solely for communication or promotion purposes.

  • The Vendor uses the information provided by you through the order process only to ship the product and to confirm delivery. We do not share this information with any third party.

  • When signing up for a newsletter from GiftOfEmbroidery.com, your email address is kept confidential and is used only for the purpose of sending newsletters, updates or special promotions.

LAW

These Terms and Conditions are governed by the laws of the Province of Ontario, Canada. The parties irrevocably submit to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.
